About this Notice
Idaho Crisis & Suicide Hotline (ICSH) is Idaho’s local 988 center and a member of the 988 Suicide & Crisis Lifeline. We are committed to protecting the privacy of the health information you share with us. This Notice of Privacy Practices (“Notice”) describes:
How we may use and disclose your protected health information (PHI)
Your rights with respect to your PHI.
Our legal duties and privacy practices.
Through the Health Insurance Portability and Accountability Act of 1996 (HIPAA), we are required by law to maintain the privacy of your PHI, to provide you with this Notice, and to abide by the terms of the Notice currently in effect. This notice replaces the June 2024 Notice.
Section 1 – How we may use and disclose your protected health information
A. Uses and disclosures for treatment and healthcare operations
Payment: We can use and share your PHI to bill and receive payment from health plans or other entities.
Treatment: We may use your PHI to provide, coordinate, or manage crisis intervention services. For example, a crisis responder may share relevant information with a mobile crisis team dispatched in response to your contact.
Healthcare Operations: We may use and disclose your PHI for internal quality improvement audits or training.
B. Uses and disclosures that do not require your authorizationRequired by LawWe will disclose your PHI when required to do so by federal, state, or local law.
Serious Threats to Health or SafetyWe may disclose PHI when we believe in good faith that such disclosure is necessary to prevent or lessen a serious and imminent threat to the health or safety of a person or the public, and the disclosure is to someone reasonably able to prevent or lessen the threat. This includes contacting emergency services (e.g., 911) to conduct a welfare check or dispatch emergency responders when we believe a help seeker’s life or another person’s life is in immediate danger.
Abuse, Neglect, or Domestic Violence
We may disclose PHI to government agencies authorized to receive reports of abuse, neglect, or domestic violence, as required by law.
Health Oversight Activities
We may disclose PHI to health oversight agencies for audits, investigations, inspections, and other oversight activities authorized by law, including oversight of the 988 Lifeline program.
Judicial and Administrative Proceedings
We may disclose PHI in response to a court or administrative order, subpoena, discovery request, or other lawful process.
Law Enforcement
We may disclose PHI to law enforcement officials for purposes such as identifying or locating a suspect, reporting a crime on our premises, or when required by law.
Coroners, Medical Examiners, and Funeral Directors
We may disclose PHI to a coroner, medical examiner, or funeral director as authorized by law.
C. Uses and Disclosures for Which You May Agree or Object
In certain circumstances, we may share your PHI if you are present and do not object, or if we infer from the circumstances that you would not object.
Persons Involved in Your Care
We may disclose PHI to a person who is involved in your care or who helps pay for your care (such as a family member, guardian, or close friend), if you are present and either agree, or we determine from the circumstances that you would not object. We will also consider the best interests of individuals who are incapacitated.
Emergency Circumstances
If you are not present or are incapacitated, we may disclose PHI to a family member, friend, or other person involved in your care if, in our professional judgment, doing so is in your best interest.
D. Uses and Disclosures That Require Your Written Authorization
Other uses and disclosures of your PHI not covered by this Notice or the laws that apply to us will be made only with your written authorization, except as required by law. You may revoke an authorization in writing at any time. However, revocation will not apply to actions we have already taken in reliance on your authorization.
E. Uses and disclosures that require your authorization include, but are not limited to:
Most disclosures of psychotherapy notes (where applicable)
Use or disclosure of PHI for marketing purposes (see Section 2 – ICSH does not engage in such activities); and,
Sale of PHI: ICSH does not engage in such activities.
Section 2 – Marketing, Facility Directories, and FundraisingICSH does not operate a facility directory, does not use or disclose your PHI for marketing purposes, and does not contact individuals using their PHI for fundraising activities. We will never sell your PHI.Section 3 – Your Rights Regarding Your Protected Health InformationYou have the following rights with respect to your PHI. To exercise any of these rights, please submit a written request to the ICSH Privacy & Security Officer using the contact information in Section 6.
Right to Access Your PHI
You have the right to inspect and obtain a copy of your PHI that is contained in a designated record set, such as your contact record. We will respond to your request within 30 days. We may charge a reasonable, cost-based fee for providing a copy. We may deny your request in limited circumstances; if we deny your request, we will notify you in writing and explain your right to request a review of the denial.
Right to Request Amendment
If you believe that PHI we hold about you is incorrect or incomplete, you may request an amendment in writing. Please include the reason you are requesting the amendment. We will respond within 60 days. We may deny the request if the information was not created by ICSH, is not part of a designated record set, or is accurate and complete. If we deny the request, we will explain the reason in writing and describe how you may submit a statement of disagreement.
Right to an Accounting of Disclosures
You have the right to request an accounting of certain disclosures we have made of your PHI since July 1, 2024. This accounting will not include disclosures made for treatment, or health care operations; disclosures made with your authorization; or certain other disclosures. We will provide the first accounting in any 12-month period at no charge; we may charge a reasonable fee for additional requests.
Right to Request Restrictions
You may request that we restrict how we use or disclose your PHI for treatment or health care operations. If we agree to a restriction, we will honor that restriction unless the information is needed to provide you emergency treatment.
Right to choose someone to act for you
You may assign a person to act on your behalf. This may include a personal representative, medical power of attorney, or a legal guardian. This person may exercise your rights and make choices about your health information. We will request proof that this person have authority to act on your behalf before we take any action.
Right to Request Confidential Communications
You may request that we contact you about your PHI in a specific way (for example, only by email or only to a specific address). We will accommodate reasonable requests. We will not ask you for a reason for your request.
Right to a Paper Copy of This Notice
You have the right to receive a paper copy of this Notice at any time, even if you have agreed to receive this Notice electronically. You may request a paper copy by contacting the Privacy & Security Officer.
Right to Be Notified of a Breach
You have the right to receive notification following a breach of your unsecured PHI, as required by applicable law. ICSH will notify affected individuals promptly in the event of a breach.
Section 4 – ICSH’s Responsibilities
ICSH is required to:
Maintain the privacy and security of your PHI.
Abide by the terms of this Notice while it is in effect.
Notify you promptly if a breach of your unsecured PHI occurs.
Not use or share your PHI other than as described in this Notice unless you authorize it in writing, and you may revoke authorization at any time.
Train all workforce members with access to PHI on applicable privacy and security requirements; and
Have appropriate safeguards in place to protect your information.
Section 5 – Changes to the Terms of this Notice
ICSH reserves the right to change the terms of this Notice at any time, provided that the changes are permitted by law. If we make a material change to our privacy practices, we will post the revised Notice on our website and make it available upon request. The revised Notice will apply to PHI we already hold, as well as PHI we create or receive after the effective date of the change.
Section 6 – Substance Use Disorder Records
To the extent that we have your substance use disorder patient records, subject to 42 CFR Part 2, we will not share that information for investigations or legal proceedings against you without (1) your written consent, or (2) a court order and a subpoena.
Section 7 – How to File a Privacy Complaint
If you believe your privacy rights have been violated, or that ICSH has not complied with applicable law or this Notice, you may file a complaint:

Contact our Privacy & Security Officer directly (see Section 8). Complaints must be submitted in writing. ICSH will not retaliate against you in any way for filing a complaint.

There is no penalty to you for filing a complaint with HHS.

Section 9 – Effective Date
This Notice of Privacy Practices is effective as of July 13, 2026. This Notice supersedes all previous versions. The most current version of this Notice is always available upon request from the Privacy & Security Officer and on our website at www.icsh.org.
