HIPAA Notice of Privacy Practices Policy

1. Purpose: The purpose of this policy is to demonstrate the Idaho Crisis & Suicide Hotline’s (“ICSH”) compliance with the HIPAA Privacy Rule’s notice requirements. Under the Privacy Rule, individuals are entitled to receive adequate notice of the uses and disclosures of their protected health information (“PHI”), their rights thereunder, and ICSH’s responsibilities with respect to PHI.

2. Policy: ICSH shall maintain a Notice of Privacy Practices (“Notice”) that complies with the content requirements under the HIPAA Privacy Rule. The Notice shall be written in plain language understandable to all help seekers. ICSH shall ensure that its workforce abides by the terms of the Notice currently in effect.

3. Publication of the Notice: ICSH shall prominently post the current Notice on its website and make the notice available electronically through the website.

4. Changes to the Notice: ICSH shall promptly revise the Notice whenever there is a material change to the uses or disclosures, the individual's rights, ICSH’s legal duties, or other privacy practices stated in the Notice. A material change to any term of the Notice may not be implemented prior to the effective date of the revised Notice except when required by law. All revised Notices must be posted promptly to ICSH’s website.

5. Requests: Help seekers are entitled to receive an electronic or paper copy of the Notice upon request. Upon receipt of any such request, ICSH shall email or mail a copy of the current Notice to any individual in the manner requested.

6. Record Retention: All versions of the ICSH-approved Notice shall be archived and maintained by the Privacy Officer for a period no less than six (6) years from the date of its creation or the date when it was last in effect, whichever is later.

(the “Company”) owns, offers, and operates the Idaho Crisis & Suicide Hotline (the “Hotline”) and the website located at https://idahocrisis.org/ (the “Website”) and the services provided thereat (the “Services”). By accessing or using the Website, you agree to this WEBSITE PRIVACY POLICY AND TERMS OF SERVICE (the “Policy”). If you do not agree with this Policy, do not use the Website or the Services.

The Company owns a variety of intellectual property. Nature and Use of Information Provided through This Service: YOUR PARTICIPATION IN ISPH CRISIS CHAT DOES NOT CONSTITUTE MENTAL HEALTH CARE OR TREATMENT AND DOES NOT CONSTITUTE AN ATTORNEY-CLIENT RELATIONSHIP, A THERAPIST-PATIENT RELATIONSHIP OR ANY OTHER SORT OF CONFIDENTIAL RELATIONSHIP. THIS SERVICE IS NOT A SUBSTITUTE FOR PROFESSIONAL HEALTH CARE. IF YOU BELIEVE YOU ARE EXPERIENCING A MEDICAL EMERGENCY, CALL YOUR DOCTOR OR 911 IMMEDIATELY. The Company, the Hotline and any of its employees, volunteers or agents are not responsible for any decisions, or results of the decisions that you make while, as a result of, or after participating in Crisis Chat. This includes whether you choose to seek or not seek professional care, or to modify or terminate specific treatment that you are currently receiving based on the information provided by this service. You assume all risk for use of this service. The Company, the Hotline and any of their employees, volunteers, or agents have no liability for actions taken by you or a third party, or not taken by you or a third party, and by using the Services you agree to indemnify us and hold us harmless for damages arising out of information provided through this service. Without limiting the foregoing, in no event shall the Company be liable for any special, incidental, consequential, or indirect damages. This service is provided on an “as is” basis and “as available” basis. The Company and the Hotline expressly disclaim all warranties of any kind, whether express or implied and make no warranty that Crisis Chat will a) meet your requirements; b) be uninterrupted, timely, confidential, secure, or error-free; or c) meet your expectations.

Privacy and Security: We take your privacy and security very seriously. Security controls, including encryption and authentication, are in place to ensure the protection of your information. Any information provided by you or collected on you will not be shared or disclosed with any third party. We do, however, reserve the right to disclose any personal information to the authorities at our sole discretion and as required by law. Despite these protections, the Internet remains an imperfectly secure environment, and the Company and the Hotline cannot guarantee protection from intruders or interceptors. You agree to use this service and submit information at your own risk. You agree that the Company and the Hotline have no liability regarding unauthorized access to this service by a third party. Please refer to our Notice of Privacy Practices for an explanation of the privacy and security of any "protected health information" that we maintain, set forth by the Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Aggregate information on Website usage is recorded, and information volunteered by site users including all data submitted is collected. This includes the use of specific services on the Website and/or Service(s) such as performing keyword searches, registering for events, or requesting additional information. We also collect and retain your e‑mail address and any other information you provide, when you communicate with us via e‑mail. We collect this information to provide online services, and to enhance our web content and improve our quality of service. You have the right to request the deletion of your Personal Information that the Company may have collected.
